UPDATE - At his Missoula Justice Court appearance on Thursday, Deputy Missoula County Attorney Brian Lowney asked Judge Landee Holloway for $100,000 bond for Pelletier. Judge Holloway set bail at $100,000, and ordered Pelletier to have no contact with the victim.

29 year-old Shane Pelletier is in the Missoula County Jail charged with felony sexual intercourse without consent after being arrested on a $100,000 warrant issued by the Missoula County Attorney 's Office.

According to court documents, Pelletier is accused of sexually assaulting a woman on July 7 after she went out drinking with friends in downtown, Missoula. The victim said she passed out and when she woke up, the defendant was sexually assaulting her. She passed out and awoke several hours later to find him assaulting her a second time.

She told police the man called himself 'Shane' and told her he found her passed out in the Main Street Parking Garage and brought her home to the Howard Apartments. The victim picked Pelletier out of a photo array and identified him as the man who sexually assaulted her.

After investigating, police found that Pelletier was supposed to have vacated his apartment by July 28.

He was arrested by U.S. Marshals in Butte and transported to the Missoula County Jail.

Felony sexual intercourse without consent carries a sentence of from four years to 100 years or life in prison and a $50,000 fine.
