A former Bozeman High School track coach accused of sexting female athletes is asking a Gallatin County judge to dismiss the case.

James Michael Evans was charged last October with felony sexual abuse of children and two counts of misdemeanor obscenity after police say he had been sending sexually explicit messages by cell phone to a 15-year-old girl.

Prosecutors say the 29-year-old tried to entice female students to engage in sexual conduct and sent three of them messages and images with inappropriate sexual content.

The defense argues the allegations in the charging documents are too broad to allow Evans to defend himself.

Evans' attorney also questions the definition of obscenity and says false and misleading statements made in charging documents and affidavits violate his client's rights.
