18 year-old Cody Lane Babcock is in the Missoula County Jail on $250,000 bond after being charged with Sexual Intercourse without Consent, Aggravated Sexual Intercourse without Consent and Intimidation, all felonies.

Deputy Missoula County Attorney Ryan Mickelson appeared before Justice of the Peace Alex Beal on behalf of the state and related the charges.

“He is charged with sexual intercourse without consent with the victim under 12 years of age for repeatedly sexually abusing a seven year-old child whom he babysat,” said Mickelson. “That carries a penalty of 100 years in prison and a $50,000 fine. He is also charged with aggravated sexual intercourse without consent for forcibly raping an inebriated 13 year-old and strangling her during the intercourse. That carries a minimum of 10 years and up to 100 years in prison and a $50,000 fine.”

Mickelson said there was a third felony related to the sexual assaults.

“In count three, he was charged with intimidation for threatening the seven year-old victim not to tell her parents what happened, and that carries a 10 year penalty and a $50,000 fine,” he said. “The dates of the crimes are all over the past year. Obviously, one charge was ongoing in nature and the dates are between this past July and this past November.”

Mickelson asked Judge Beal that Babcock be held on $250,000 bond and Beal granted the request.

Babcock’s case will be heard next in Missoula District Court. Meanwhile he remains in the Missoula County Jail on $250,000 bond.
