BISMARCK, N.D. (AP) — The jury in the case against two men accused in a fatal North Dakota shooting will continue deliberating on Thursday.

Twenty-nine-year-old Richard Whitman and 24-year-old Cody Borner have pleaded not guilty to a murder conspiracy charge in the Jan. 31 death of 22-year-old Mike Padilla in his apartment and the wounding of his 21-year-old brother, Timothy Padilla of Billings, Mont.

The Bismarck Tribune reports that the 12 jurors will return on Thursday.

The judge gave final instructions to the jury Wednesday afternoon before releasing a 13th juror that had listened to testimony as an alternate.
