Missoula, MT (KGVO-AM News) - On January 19, 2026, at approximately 5:57p.m., a Missoula Police Department officer conducted a traffic stop on a 2007 White Dodge Caravan at the intersection of North Russell St and Montana St. The officer observed two illegal traffic actions. Then the officer ran the license plate and learned that the registered owner, 67-year-old Kerry Maclane, was a suspended driver. The officer activated emergency lights, and the vehicle pulled over. 

The officer introduced himself and explained the reason for the stop. The officer requested registration and insurance. Maclane admitted that his license was suspended for a prior DUI conviction and that he did not have insurance. According to court documents, records showed three prior no-insurance citations. 

While speaking with Maclane, the officer noticed a strong odor of an alcoholic beverage coming from the vehicle. When asked if he had consumed alcohol that evening, Maclane said no. The officer returned to the patrol vehicle to prepare a citation, then returned to Maclane to obtain his phone number and confirm his address.

At this time, Maclane was chewing a breath mint. The officer found this suspicious because it appeared, based on the officer’s training and experience, that Maclane was attempting to mask the odor of alcohol. 

The officer asked Maclane to exit the vehicle and walk to the front of the patrol car. The officer explained the suspicion of impairment and requested Maclane participate in standardized field sobriety tests (SFSTs). Maclane initially claimed the tests were “fake” but agreed to participate. The officer observed 16 out of 18 indicators of impairment. 

Then the officer read Maclane the preliminary alcohol screening test advisory, and Maclane provided a breath sample over the legal limit of 0.08 BAC. Maclane became irate and verbally confrontational, repeatedly asking about his vehicle despite receiving answers.  

The officer instructed Maclane to walk to the back of the patrol vehicle. Maclane resisted and refused to get in the patrol vehicle. Ultimately, the officer was able to pull Maclane’s arm away and secure Maclane in the back seat.

The officer read the Implied Consent Advisory, but Maclane refused breath and blood tests, yelling throughout. A criminal history check revealed six prior DUI convictions, making this arrest his seventh and a fourth-or-subsequent offense.  

The officer transported Maclane to the Missoula Police Department, obtained a search warrant, and later transported Maclane to St. Patrick’s Hospital for a blood draw. Due to prior resistance and threats to refuse, Maclane was placed in a restraint chair for the draw. Two vials of blood were collected, and then Maclane was transported back to the jail.  

Maclane is currently being charged with felony DUI, resisting arrest, and driving with a suspended license. His bond was set at $50,000.
