BILLINGS, Mont. (AP) — A coroner's inquest to determine whether a Yellowstone County sheriff's deputy was justified in fatally shooting a suspect in January is set for this summer.

County Attorney Scott Twito tells the Billings Gazette the inquest is scheduled for July 9.

Sheriff's officials say Clay Hackbarth was responding to a report of suspicious activity at a home in Lockwood when he was confronted by 24-year-old Edward Stump. Sheriff's officials say Hackbarth returned fire after Stump allegedly fired at Hackbarth.

According to the Montana Department of Corrections website, Stump was on probation in Billings after having been convicted of felony assault with a weapon in Cascade County in 2010.
