Even though he is not running in the coming election, Max Baucus has already started advertising and campaigning to keep his Senate seat in 2014. Secretary of State candidate Drew Turiano says that even if Baucus wins re-election, he would not certify the election because doing so would be against the Montana State Constitution. Turiano spoke with KGVO News about his opinion on this and other topics.

Most Secretary of State candidates would certify Baucus' re-election because of a 1995 Supreme Court ruling that says that States do not have the authority to regulate the tenure of federal legislators (here is the current Secretary of State's position).
