MISSOULA, Mont. (AP) — A lawyer who represented former Montana state Sen. Greg Barkus after a boating crash that injured U.S. Rep. Denny Rehberg is facing a charge of aggravated drunken driving.

The Missoulian reports the Montana Highway Patrol pulled over Todd Glazier around 1 a.m. Monday, and a preliminary breath test indicated his blood-alcohol level was .226 percent. That is more than double the legal driving limit of 0.08 percent. Glazier also is accused of failing to signal an intent to turn.

Glazier has pleaded not guilty.

Glazier had represented Barkus, who pleaded no contest to felony criminal endangerment for crashing his boat on the rocky shores of Flathead Lake after a night of drinking in 2009.

All five people on board including Rehberg were injured.
