Valentine's Day is coming up soon. For some in Montana that may mean that "love is in the air". After all, the holiday is all about romance. When I was younger I used to watch the television show "Happy Days". There were references in the show about "Inspiration Point" and to characters going to the lake to watch "the submarine races". It wasn't until I was much older that I realized what they were talking about. With all the driving and parking that was going on back then, I was curious about the legalities of having sex in a vehicle in Montana.'
Montana Laws Reflect A Lot of Other States
Montana, is like a lot of other states, in that there is no specific law against making love in a vehicle. The laws aren't related to the vehicle per se, the laws are more related to if someone can witness it happening. If you choose to attempt to make love in a vehicle in the privacy of your garage, you are not breaking any laws. If you try that in, for example, a parking lot, or on the street or an alleyway, where people can witness it you can be charged with "indecent exposure", "disorderly conduct" or "obscenity", according to Schmidt & Clark LLP a National Law Firm.
There are Other Laws That You Could Be Breaking
In Montana if found guilty of "disorderly conduct" a person can be fined up to $100 and up to 10 days in jail. If a person is found guilty of "Indecent Exposure" that person can be fined up to $500 and up to 6 months in jail. If a person is found guilty of "Obscenity" in Montana that person can be fined between $500 and $1,000 and jailed for up to 6 months.
Be Aware of the Laws Montana
With the "romantic" holiday coming up, be warned of the consequences of getting too "frisky" in your vehicle. It just may not be worth it in the long run.
