Missoula, MT (KGVO-AM News) - On May 15, 2023, at approximately 10:50 p.m., a Missoula Police Department Officer was dispatched to the area of Burns Street and Phillips Street for a report of suspicious activity. The complainant reported seeing a male in the area checking vehicle handles. The complainant stated the male was on a bike pulling a bike trailer and was last observed on Burns Street.  

An officer was near the location already and upon arrival, he observed a male on a bike pulling a bike trailer. The officer illuminated the male with his patrol vehicle spotlight. The officer asked the male to stop and speak with him, which he did. 

The officer quickly noticed that the male matched the description of 53-year-old David Guinard, who the officer was aware had two active felony warrants for his arrest. The officer advised Guinard that it was reported he was checking vehicle door handles in the area, but Guinard denied that allegation. The officer then asked Guinard if he had any identification and Guinard stated he did not. However, Guinard confirmed his identity.

The officer asked Guinard to set his bike down and once he did, the officer secured Guinard’s wrists and placed him into handcuffs. Officers confirmed with dispatch that Guinard’s warrants were still active and guided him toward a patrol vehicle.  

Officers asked Guinard if he had anything in his pockets that would poke or stab them, and Guinard stated he could not remember. An officer conducted a search of Guinard’s person incident to arrest. While conducting the search, the officer observed Guinard pushing his front pant pocket against the patrol vehicle, preventing the completion of the search. The officer had to ask Guinard several times to back away from the patrol vehicle. 

While searching Guinard’s left front pant pocket, the officer located a syringe and plastic bag of suspected methamphetamine. Inside Guinard’s left coat pocket was a glass pipe with a bulbous end that had residue in it. Each of these items were seized and Guinard was transported to the Missoula County Detention Facility. 

According to court documents, the officer conducted a NIK test of the suspected methamphetamine, and it tested presumptive positive. Guinard is currently being charged with felony criminal possession of dangerous drugs and criminal possession of drug paraphernalia. On May 16, 2023, Guinard made his initial appearance in Missoula Justice Court and his bond was set at $10,000. 

On April 6, 2022, Guinard was charged with felony criminal endangerment after a standoff with police.
