LIVINGSTON, Mont. (AP) — The Park County attorney has filed a rare charge against a couple accused of selling marijuana because he says their 11-year-old son was involved in the operation.

Brett Linneweber has charged 44-year-old James Heilman and 36-year-old Holly Schmitz with criminal production of marijuana and criminal possession of mushrooms. In addition, Linneweber charged the couple with use or possession of property subject to criminal forfeiture.

The Livingston Enterprise reports that the couple's home and 20 acres could be seized if they are found guilty of that last charge.

Linneweber says the charge is harsh but that an 11-year-old should not be handling drugs.

Charging documents cite an interview with a boy who said the 11-year-old told him he could sell a bag of marijuana for $400.
