The state says it will be appealing a district court's decision to block parts of a new restrictive medical marijuana law.

That lower court ruling blocked Montana from prohibiting commercial medical marijuana operations in a preliminary injunction that also undid a ban on advertising of medical marijuana.

Many other portions of the stricter law were allowed to go into place.

The Montana attorney general's office on Tuesday filed notice of its intent to appeal the June ruling. Assistant attorney general Jim Molloy says they are concerned about the legal determination that the Montana Constitution protects the right to sell marijuana for a profit.

Medical marijuana advocates argue the new law is unconstitutional violation of the right to pursue good health.
