Montana Attorney General Tim Fox's office is asking a state judge to deny a restraining order request filed by the Flathead Joint Board of Control against the CSKT Compact.

The motion (a copy of which, is provided below) says that the restraining order request is "frivolous" and that "plaintiffs' request for relief is breathtaking and unprecedented."

The motion from the AG's office lists four points of contention with the restraining order attempt. The main argument has to do with the lack of a "ripe" harm and that the injunction is based on possible future lawsuits from possible future harms that have not occurred.

The motion goes on to argue that the plaintiffs lack standing, and finally, that the "plaintiffs have presented a purely political, non-justifiable question that, if seriously entertained by this Court, would wreak havoc in the legislative process."
