The Montana Supreme Court upheld a 27-year-old Missoula man's conviction and sentence for accountability to a September 2012 convenience store robbery, but sent the case back to District Court to set restitution.

Preston James Hanna was convicted of being the getaway driver in an East Missoula robbery in which Ole's convenience store clerk Adam Gallegos was shot in the chest, losing his lung. The court sentenced Hanna to 30 years in prison with 10 suspended, ordered him to register as a violent offender and requested that the Board of Pardons and Adult Probation Office review restitution prior to Hanna's release from prison.

The Supreme Court on Dec. 30 rejected arguments that Hanna didn't know a co-defendant was going to rob the store, but said the District Court must set the restitution amount.
