Missoula, MT (KGVO-AM News) - On January 4, 2023, a Missoula Police Department Officer was on duty when he saw a male leaving the area of the 1600 block of Phillips Street, walking eastbound through the alley. That address is known to law enforcement for ongoing drug-related illegal activity. As the officer got closer to the male, he recognized him as 31-year-old Danial Hendry.  

The officer was aware that Hendry was on probation and had an outstanding warrant at that time. The officer contacted Hendry in the alley and informed him of the warrant. The officer then placed Hendry in handcuffs.  

Prior to searching Hendry incident to arrest, the officer asked him if he had anything on him such as guns, knives, needles, or drugs. Hendry sighed and shook his head yes. He told the officer that fentanyl & "dope" was in his coat pocket. The officer began searching Hendry.  

In the left chest interior coat pocket, the officer removed a folded piece of foil. Hendry said it was fentanyl. In another interior pocket of Hendry's coat, the officer located a small plastic toy soda can. The top had a tab on it. Hendry told the officer there was a fentanyl pill in it. As the officer continued searching Hendry, Hendry told the officer his "kit" was in the backpack he was wearing. Hendry gave the officer verbal consent to search his backpack.  

Inside the backpack were several syringes, cotton swabs, alcohol wipes, and a folded piece of foil. Court documents indicate two of the syringes had a clear liquid substance in them. Through the officer’s training and experience, he recognized the substance as consistent with methamphetamine. Amidst the other paraphernalia was a small, folded piece of foil. Hendry said the meth was in the foil. 

The officer later tested the clear liquid substance in both syringes. The TruNarc indicated that both syringes contained suspected methamphetamine. Using the TruNarc still, the officer tested the crystalline substance in the foil. The TruNarc indicated the foil also contained suspected methamphetamine.  

Due to the high risks of handling the suspected fentanyl, the officer only photographed the pill and the container. The pill was a small blue round pill and it had a distinct "30" stamped into it. 

Hendry is currently being charged with felony criminal possession of dangerous drugs and criminal possession of drug paraphernalia.

On November 10, 2022, Hendry was charged with felony theft. On July 20, 2021, Hendry was charged with felony attempted theft. On January 19, 2021, Hendry was charged with felony theft and felony criminal possession of dangerous drugs. On February 16, 2021, Hendry was charged with felony criminal possession of dangerous drugs.
