On March 14, 2022, Missoula Police Department Officers were dispatched to a residence in the 130 block of South Travois Street for the report of intimidation. The female victim said her ex-boyfriend, 47-year-old Daryl York, showed up to the house she was at and threatened her. Police Public Information Officer Lydia Arnold explains.

“Officers responded to a report of intimidation,” Arnold said. “When they arrived on scene, they learned it was a domestic related disturbance and a weapon was involved. The victim described they had not invited the suspect, Daryl York, to the residence and York was not supposed to know where the victim was staying. The victim described York knocking on the door. When the door was answered, York stepped into the residence and smelled of alcohol. York stood in the doorway. When the victim stated they did not want to speak to York or have York present at the residence, York presented a replica handgun.”

Court documents indicate York told the victim that he was going to hurt her. York allegedly took a black pistol out of his pocket and “cocked it.” The victim told officers she thought York was going to shoot her.

“The victim was not able to distinguish the difference between a handgun and a replica handgun,” Arnold said. “York made comments and manipulated the replica gun causing the victim to fear for their safety. Officers located York and also located the weapon used in the altercation. When officers were speaking with York and conducting a pat down search, a substance was located that tested presumptive positive for methamphetamine.”

Officers located York between two storage containers near the intersection of Hudson and Palmer. Under one of the containers, an officer observed what appeared to be a black-colored handgun, which was later identified as a Daisy brand BB gun. York denied being in possession of a pistol and denied threatening the victim.

The victim later identified the BB gun as the gun that York had in his possession. The BB gun has a functioning slide that moves as if the same as an actual firearm.

York is currently being charged with felony assault with a weapon, felony criminal possession of dangerous drugs, and partner or family member assault.
