What is a Mining Claim?

Seeing land for sale that references mining claims is sort of unique to Montana compared to buying real estate in other parts of the country. According to the Bureau of Land Management,

A mining claim is a parcel of land for which the claimant has asserted a right of possession and the right to develop and extract a discovered, valuable, mineral deposit. This right does not include exclusive surface rights. - blm.gov

You would need to contact the real estate agent to find out if the land is separate from the mining claims, but based on the listing, it does mention that you could "build a cabin" or have other temporary living structures like a tiny house.

What Is Deeded Access?

The listing says that there is a road but it doesn't have deeded access which means that if you owned the land, you wouldn't necessarily own the way to get to that land. The listing does say, "...bring cash or seller may carry. No deeded access is also deemed uninsurable access. Folks have been accessing the claims for over a century, but easements were never included on the roads. This is unlikely to ever change." Might be something else to ask the agent about.
