
Driver Passed Out in Downtown Missoula Arrested for Felony DUI
Missoula, MT (KGVO-AM News) - On September 11, 2026, a Missoula Police Department officer responded to the Bodega Bar at 221 Ryman Street after a 911 caller reported a female passed out in the driver's seat of a running Dodge truck. The caller said the female appeared intoxicated and was leaning back with their mouth open. The officer arrived at approximately 2:40 AM.
Upon arrival, the officer approached the driver’s side window and observed the driver, later identified as 34-year-old Jack Marso, passed out. The officer knocked on the window several times but was unable to wake Marso. The officer then opened the driver’s side door, and Marso became alert and responsive.
The officer informed Marso about the call for service and determined Marso was not experiencing a medical emergency. While speaking with Marso, the officer observed that Marso had a dazed expression, red and watery eyes, and an odor of an alcoholic beverage coming from his breath. The officer asked Marso if he had consumed an intoxicant that evening. Marso stated he had consumed a beer at a comedy show at approximately 9:00 PM.

The officer noted, based on training and experience, that the observed indicators would not still be present after only one beer five hours prior. The officer then asked Marso to participate in Standardized Field Sobriety Testing to ensure Marso could safely operate the vehicle. Marso agreed, stepped out of the vehicle, and participated in the tests.
Then the officer began to read Marso the Preliminary Alcohol Screening Test Advisory. Marso’s mood shifted, and he became highly agitated, demanded a lawyer, and stated he would not speak further or participate. The officer placed Marso under arrest due to refusal to listen and agitation.
Marso was secured in handcuffs and escorted to the patrol vehicle, where the officer was able to read the PAST advisory in its entirety. Marso refused to provide a breath sample. After a search incident to arrest, Marso was placed in the patrol vehicle. The officer read Marso the implied consent form. Marso repeatedly stated he refused to do any further testing. After reading the form, the officer asked Marso to provide further testing, and Marso again refused.

The officer transported Marso to the Missoula Police Department holding cell and detained him pending approval of a DUI blood warrant. Once the warrant was approved, the officer transported Marso to St. Patrick’s Hospital. At the hospital, a blood draw was performed on Marso. Then the officer transported Marso to the Missoula County Detention Facility.
Marso is currently being charged with felony DUI. According to court documents, Marso has three prior DUI convictions.
