Montana Attorney General Tim Fox announced on Wednesday that he is joining a bi-partisan coalition of 49 Attorneys General asking Congress to amend laws to fight prostitution and child sex trafficking, by amending the Communications Decency Act.

Communications Director Anastasia Burton said Wednesday morning that Fox and the other Attorneys General want criminal jurisdiction provided to state and local prosecutors.

“The Communications Decency Act was drafted in 1996, when the internet was in its infancy and the purpose was to protect children from accessing indecent materials online,” Burton said. “However, some courts have interpreted the statute to provide immunity from state prosecution to online classified ad sites that promote sex trafficking.”

Burton said Attorney General Fox wants the law updated.

“He believes the federal law needs to be modernized to provide local prosecutors the tools necessary to strike back against those who use technology to promote sexual exploitation of children.”
