Four medical marijuana providers have filed a lawsuit seeking to overturn an emergency ordinance approving a 90-day ban on storefront medical marijuana businesses in Billings.

A lawsuit filed by William M. Reid and three John Does argues the city council labeled the ordinance an emergency to circumvent normal procedures in adopting an ordinance, which would include two public hearings 14 days apart.

The lawsuit alleges there was no emergency and argues an emergency is a "serious, unexpected and often dangerous situation."

The plaintiffs, represented by attorney Chris Lindsey, say the council's actions on July 1 violated their due process rights and their right to engage in business activity.

City Attorney Brent Brooks says the city is reviewing the lawsuit.
