A 52-year-old Lolo man seeking a new trial after being convicted in the drunken-driving death of a Missoula pedestrian is also asking to have his driver's license returned.

Brian Holm has yet to go to prison after being convicted in August of vehicular homicide in the death of 23-year-old Brian Beaver of Aberdeen, Ore., who was killed after Holm's car jumped the curb and struck him.

Holm wants an expensive alcohol-monitoring bracelet removed and is seeking permission to start driving again. He argues he has been unable to work.

Missoula County District Court Judge Dusty Deschamps sentenced Holm to 30 years in prison with 15 suspended, but delayed sending him to prison pending an appeal.

Holm has filed several motions seeking to put aside his conviction.
