Kalispell Man Gets 30 Years For DUI Deaths

KALISPELL, Mont. (AP) — A Kalispell man has been sentenced to 30 years in prison for driving drunk and hitting another vehicle head-on, killing his passenger and the driver of the other vehicle.

The Daily Inter Lake reports District Judge Ted Lympus sentenced Joseph Powell on Tuesday to 30 years in prison for each of two charges of vehicular homicide while under the influence. Powell pleaded guilty to the charges filed after the October 2013 deaths of 43-year-old Brian Delaney and 43-year-old Patrick Moulton, both of Kalispell. The sentences are to run concurrently.

Powell, who was 46 at the time of the crash, suffered a broken arm and dislocated right hip.

Powell also must complete a 180-day treatment program at the Warm Springs Addiction, Treatment and Change, or WATCh, program.

Lympus also ordered Powell to pay nearly $5,500 in restitution.
