BILLINGS, Mont. (AP) — A 25-year-old Billings man has pleaded not guilty to assaulting a 3-month-old boy in his care.

Levi Brian Jarod Boucher was arraigned Tuesday before District Judge Russell Fagg.

Boucher is charged with felony aggravated assault after the child was taken to a hospital with head injuries in September 2010.

Prosecutors say Boucher was watching the boy when he called the child's mother at work to say he had dropped the infant.

Medical reports indicated the child suffered a serious internal head injury that appeared to be from repeated physical abuse.

Police received medical records in November that show the child's development has been delayed, he was receiving physical and occupational therapy and required medication to treat seizures.
