A sixth judge has recused himself from resentencing a former Billings teacher who violated the terms of a deferred sentence he received for raping a 14-year-old student in 2007.

Stacey Dean Rambold was sentenced in 2010 after pleading guilty to one count of rape. The girl committed suicide before the case went to trial.

District Judge G. Todd Baugh (baw) sentenced Rambold to 31 days in prison for the violations. The state argued he should have been given at least four years. In April, the Supreme Court ordered Rambold re-sentenced, but not by Baugh.

The other five judges in the 13th Judicial District recused themselves and last week District Judge Mary Jane Knisely assigned the case to Judge George Huss in Forsyth. Knisely said Thursday that Huss recused himself and she assigned the case to District Judge Randal Spaulding in Roundup. A sentencing date has not been set.
